Cellular Phone Bylaw (Bylaw 27-2009)


The bylaw takes effect September 1, 2009. Those caught talking and driving will face a $100 fine for a first offence and $200 fines for subsequent violations. The fines will be enforced on a road under the direction, control and management of Strathcona County.

Why is Strathcona County introducing this bylaw? Strathcona County is following the lead of some other jurisdictions to curb cell phone use by drivers. The County has taken this step because cell phone use while driving is one of many driver distractions that pose a safety hazard to the driver and to all other users of the road. The proposed bylaw follows similar measures to curb cell phone use by drivers in other jurisdictions including: Nova Scotia, Newfoundland/Labrador, Quebec, Ontario, some U.S. states, most European countries, Australia and Japan


What is the definition of "using" a cell phone while driving? Using includes dialing, answering, talking, texting and/or listening to a cell phone.


How will the bylaw be enforced? Enforcement of the bylaw will be handled by the RCMP, who may issue a Violation Tag to any driver the officer believes has contravened the bylaw. Those guilty of contravening the bylaw would be liable to a fine of $100 for the first offence and $200 for subsequent offences.


Are there any exemptions? Drivers may use hands-free cell phones. Drivers may use hand-held cell phones if their vehicle is parked, or if they are calling in cases of emergency. The bylaw does not apply to emergency personnel in the course of their duties.


What is the definition of a County-controlled road? County-controlled roads include all thoroughfares the public is normally permitted to use with the exception of the following highways: 14, 16, 15, 21, 38, 216, 628, 629, 630, 824, 830 and Range Road 214 between Highway 15 and Township Road 550 and Range Road 210 north of Highway 15.
